Apple doesn't appear to be suing for breach of contract. Apple is suing for damages due to decreased sales from GEEP's theft of 100,000 devices.

Apple filed that suit in January, and GEEP filed a suit against Apple in July that GEEP didn't steal the devices but three rogue employees.
