Whatever your position on this whole Big Tech vs DMA thing, it's clearly Apple going for another very obvious way to go around it.

This time trying to justify a decision that allow them to avoid what the DMA wanted, by using an US court decision, which lead us to this new situation where as expected the EU is now looking into it and as quoted "We are also evaluating whether Apple’s actions raise doubts on their compliance with the DSA (Digital Services Act) and the P2B (Platform to Business Regulation), given the links between the developer programme membership and the App store as designated VLOP (very large online platform)".

Aka, "we think they're trying to use their developper program as a backdoor to circumvent their obligation regarding the DMA, and if they want to play that game fine we're going to put rules on that too" ..

Not sure if there is a long term gain for Apple here, the DMA left them in total control of their developper program and I doubt they will benefit if they keep forcing the EU to intervene. It's sort of weirding me out because I really don't understand what they think their end game is ... That the EU let it go and pretend not to see it ? Therefore implying from now on big tech can ignore our rules ? Not going to happen.

Doesn't matter if you think the DMA is good or bad, we can all agree that if a gov makes a law and you go out of your way to say "I don't care I'm going to ignore you", you're forcing them to prove they are in charge, especially with Microsoft, Meta, Google, Amazon & co waiting in the bushes to jump on any step back.
