Polite correction: that's how you know your position has been decided against. Judges (including appellate judges) fail/refuse to apply their own rules in order to reach the result they want all the time, and they often get decisions wrong unintentionally too.
Thank you, indeed. I was thinking that "you get ruled against" was at the SCOTUS level, and therefore unappealable, or at the ran-out-of-money level. I was unclear, my apologies and gratitude for the correction.
